  1. scope
    These terms and conditions apply to the rental of:
    - Hotel rooms
    - Conference rooms
    - Banquet and event rooms
    as well as for all other related services of the SBHBG.
    1.1 Contract language is German
  1. Conclusion of contract, liability
    2.1 The contract is concluded by the acceptance of the order (confirmation) by the SBHBG to the client and is binding upon acceptance of the order. The contracting parties are the client (organizer, guest, company) and the SBHBG.
    2.2 Subletting or further leasing requires the written consent of the SBHBG.
    2.3 Even in the event of an order for third parties (e.g. as an agent), the client shall be jointly and severally liable with the latter for all obligations arising from this contract.
    2.4 The client is liable for loss or damage caused by his side as well as for loss or damage caused by himself. It is the organiser's responsibility to take out the appropriate insurance. In order to prevent damage, no (decorative) material may be attached to walls or similar without prior written permission.
    2.5 The SBHBG is only liable for objects that have been brought in. Objects that are left in generally accessible rooms of the SBHBG are not considered as brought in. Valuable objects are to be deposited at the reception. The scope of liability of the SBHBG is, except in cases of intent or gross negligence, limited to a maximum of 2,000, - Euro.
    2.6 All open fires, sparklers, fireworks etc. are prohibited on the castle grounds due to fire hazard; special agreements are excluded.
  1. Services, prices, payments
    3.1 All agreed prices include the statutory value added tax. Any increase in value added tax after conclusion of the contract shall be borne by the customer.
    3.2 If the period between the conclusion of the contract and the event exceeds 12 months, the SBHBG reserves the right to make price changes up to a maximum of 10%.
    3.3 The invoices of the SBHBG are payable within 10 days from the date of invoice without deduction.
    3.4 The SBHBG is entitled to demand an advance payment of 50 % of the expected turnover in the offer. Third party services ordered by the client that are invoiced via the hotel can also be demanded as advance payment.
    3.5 A cash payment is possible up to a maximum of 10,000 euros, a denomination of the invoice is not permitted.
  1. Resignation
    If the advance payment is not made even after the expiry of a reasonable deadline set by the SBHBG, the SBHBG is entitled to withdraw from the contract.
    Furthermore, the SBHBG is entitled to withdraw from the contract for objectively justified reasons, e.g. force majeure.
    The SBHBG must inform the client of this without delay.
    There is no claim for compensation, except in the case of grossly negligent behaviour on the part of the SBHBG.
    If the organizer is a political or ideological association, a written approval of the SBHBG is additionally required for the effectiveness of the contract. If the organizer conceals that he represents such an association, the SBHBG is entitled to terminate the contract without notice.

    The cancellation conditions also apply (see point 8).

  1. Food and drinks brought along
    Food and drinks brought with you may not be consumed in the generally accessible areas of the castle grounds, unless an individual special arrangement such as cork or cover charge has been agreed.
  1. Room changes
    The SBHBG reserves the right to make room changes, as far as this is reasonable for the contractor.
  1. Arrival, departure, use of space
    Reserved hotel rooms are available to guests from 15.00 hrs.
    On the agreed day of departure, the room must be vacated by 11.00 a.m. Additional costs will be charged for later departure.
    If the hotel room is not occupied by 18.00 hrs, the hotel can rent the room to another person. Announced late arrivals are excluded from this.
    Conference and event rooms are available from 7.00 am to 22.00 pm on the day of the event.
  1. Cancellation conditions and costs, change of number of participants
    The client may cancel / adjust 10% of the number of participants / rooms free of charge up to 7 days before the start of the event
    The date of receipt of the cancellation by SBHBG is decisive for the calculation of the deadline.
    In all other respects, the statutory provisions apply in the event of cancellation by the client. Postponement of the event corresponds to cancellation.
  1. Retrieval quota
    Call-off quotas will be returned to SBHBG after the contractually agreed period before arrival / start of VA. Conference lump sums will not be automatically transferred to the called-off
    Room adapted, please note the cancellation conditions of the corresponding group size.
  1. Additional agreements, place of jurisdiction
    Additional agreements are only binding if they have been confirmed in writing.
    Place of jurisdiction is Bamberg.
  1. Severability clause
    Should a provision of the AGB be invalid, this shall not affect the validity of the other provisions. German law shall apply.
